Privacy policy

This privacy policy sets out how PCV Pty Ltd trading as Pool Compliance Victoria (ABN 95 609 595 338, ACN 639 224 810) collects, holds, uses and discloses personal information. In this policy, we, us and our mean PCV Pty Ltd. Our website is https://poolcv.com.au.

This policy replaces the privacy section previously published in our terms, which incorrectly named another entity. This policy applies to information collected offline and online, including through this website and when you book an inspection.

Personal information we collect

The types of personal information we may collect about you include:

  • your name
  • contact details, including email address, phone number, mailing address and the job / property address for the pool or spa
  • business or company name, if you give it
  • whether the pool or spa is registered with the local council, and documents you upload (for example a registration letter)
  • details of services you have booked or enquired about, preferred times, and our response
  • photographs or video of the site taken during an inspection, as described in our terms
  • browser, device and usage data collected through cookies and similar technologies, including Google Tag Manager
  • any other information you provide in a message, booking form or phone call

We do not require sensitive information (as defined in the Privacy Act 1988 (Cth)) to book an inspection. Please do not send health or other sensitive information unless we ask for it.

How we collect and use it

We collect information directly from you, from someone acting on your behalf (for example a real estate agent or family member), and from our systems when you use the website. We use it to:

  • provide pool and spa barrier inspections, certificates, owner notices and related advice
  • schedule visits, take payment or send invoices, and communicate about your booking
  • liaise with the relevant local council where the Building Act 1993 or Building Regulations 2018 require it
  • operate, secure and improve this website
  • comply with legal obligations and resolve disputes
  • send service messages; we will only send marketing if you would reasonably expect it, and you can opt out at any time

If you do not provide the information we need to inspect a property (including the job address), we may not be able to offer a booking or a certificate.

Who we disclose it to

We may disclose personal information to:

  • our staff, contractors and registered building inspectors who carry out the services
  • ServiceM8, which we use as our job and scheduling system for online bookings
  • the local council for the property, the Victorian Building Authority (VBA), and other regulators or courts as required by law — including when a certificate of compliance or non-compliance must be issued
  • IT, hosting, email and payment providers who process information for us
  • professional advisors, and anyone to whom our business may be transferred

Some providers may store data outside Australia. Where we disclose personal information to them, we take reasonable steps so that they handle it consistently with this policy.

Cookies and analytics

We use cookies and Google Tag Manager (container GTM-N9498W9) to understand how the site is used and to measure enquiries and booking clicks. Cookies do not by themselves tell us your name or email. You can control cookies in your browser.

Storage and security

We take reasonable physical, electronic and organisational steps to protect personal information from misuse, interference, loss, and unauthorised access, modification or disclosure. Transmission over the internet is not completely secure, and you send information at your own risk.

Access, correction and complaints

You may request access to the personal information we hold about you, or ask us to correct it. We may refuse access in the circumstances set out in the Privacy Act 1988 (Cth). An administrative fee may apply for access.

If you believe we have breached the Australian Privacy Principles, contact our Privacy Officer with the details. We will investigate and respond in writing. If you are not satisfied, you may complain to the Office of the Australian Information Commissioner (oaic.gov.au).
